Scrubbing of Service Explicit Messages to DND subscribers with effect from 08:00 am on 16. 01.2024 onwards as per TRAI Direction

Dear TrueConnect Subscriber,

Kindly note that in compliance with the TRAI Directions, we will now be scrubbing Service Explicit Messages for Promo blocked DND subscribers with effect from 08:00 am on Tuesday 16. 01.2024. This is in addition to the scrubbing already being done for Fully Blocked DND subscribers.

This implies that effective 16.01.2024, no promotional or service explicit messages will be allowed to be sent to DND Subscribers – either fully blocked or Promo/partially Blocked. So effectively, only those subscribers who are not on DND or have given explicit Digital Consent will be allowed to receive Promotional and Service Explicit messages.

In addition, the industry will soon be migrating 100% to Digital Consents and all existing paper/email/online/webform/database/screenshot consents or any type of deemed consents will cease to be treated valid. This would mean that any complaint will have to be backed by Digital Consent only, failing which it will be treated as a valid complaint, even if the templates may have been registered under service category. Such valid complaints may attract financial penalties and blocking/blacklisting of your traffic subject to the seriousness of the violation(s).

In view of the above, we urge you to closely review all your service templates registered on our DLT platforms, and edit/block those which are promotional (even partially) in nature or have variables that may be used for sending promotional/inappropriate/fraudulent messages. You may re-register such templates under appropriate promotional category, with maximum fixed content, and less of variable content, so as to not allow misuse of your templates and its consequent impact on your commercial communication and brand reputation.

We are also reviewing all your service content templates registered on our DLT platform and will blacklist templates, which do not adhere to their stated purpose/classification, or have such variable portion that can be misused for sending inappropriate communication, with or without prior notice to you. We shall also be blocking/blacklisting templates which are reported as promotional/inappropriate/fraudulent in customer complaints, or identified through our UCC-Detect mechanisms or reported by regulators/law enforcement agencies, as the case may be, with immediate effect. Any complaints still reported for promotional content from your service templates, will solely be your responsibility and you will be liable for any consequences arising therefrom.

This is for immediate needful action at your end so that the new scrubbing change, and this template review exercise does not impact your business/customer communications, or your own reputation, or bring you undesirable financial disincentives.
